This website is owned and operated by Activate School Fundraising, Inc. (“Activate,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) set forth the terms under which you may access and use GoFundSchools.com and any services offered through the site.

GoFundSchools.com provides online tools and services to support school fundraising programs, including donation processing, fundraising pages, reporting tools, and related program support.

By accessing or using this website or any services offered through it, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the website or services.
 

2. Who May Use the Website

To use this website and/or receive our services, you must:

  • Be at least 18 years of age, or the age of legal majority in your jurisdiction

  • Have the legal authority to enter into a binding agreement

  • Not be prohibited from using the website or services under applicable laws or regulations

Accounts may be created by authorized school representatives, parents, guardians, donors, or other users participating in school fundraising activities.
 

3. Key Commercial Terms

Donations

All donations made through GoFundSchools.com are voluntary contributions to school fundraising efforts. Donations are generally non-refundable, except in cases of processing errors or as required by law.

Fees

Credit card donations are processed through a third-party payment processor. Processing fees may apply. In some cases, donors may be given the option to cover processing fees; any uncovered processing fees may be deducted from gross fundraising proceeds, as outlined in school agreements.

Pricing for Services

Program pricing, deposits, and payment schedules for schools are outlined in separate written agreements between Activate and participating schools or organizations. We reserve the right to update pricing for future programs.
 

4. Return and Refund Policy

Because GoFundSchools.com primarily facilitates charitable donations and fundraising services:

  • Donations are non-refundable once processed, except in cases of duplicate charges, fraud, or technical error

  • Program fees paid by schools are governed by the terms of their individual service agreements

5. Right to Change or Discontinue Services

We may, at any time and without prior notice:

  • Modify or discontinue any part of the website or services

  • Change features, functionality, or availability

  • Suspend or terminate access to the website or services

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.
 

6. Warranties and Disclaimer

The website and services are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, Activate disclaims all warranties, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

We reserve the right to suspend or terminate any account or access to the website, with or without notice, if we determine that:

  • These Terms have been violated

  • The website or services are being misused

  • Any applicable law or regulation has been violated

Users may discontinue use of the website at any time.
 

10. Indemnification

You agree to indemnify and hold harmless Activate School Fundraising, Inc., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of or related to:

  • Your use of the website or services

  • Your violation of these Terms

  • Your violation of any rights of a third party
     

11. Limitation of Liability

To the maximum extent permitted by applicable law, Activate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the website or services.

Activate’s total liability for any claim shall not exceed the amount paid by you (if any) for use of the services in the twelve (12) months preceding the claim.

By using the website, you agree that we may send you service-related and promotional communications via email or other contact methods you provide. You may opt out of promotional communications at any time by following unsubscribe instructions or contacting us directly.
